Enhanced maternity pay and shared parental leave
The Court of Appeal has ruled that it is not discriminatory for employers to enhance maternity pay while only offering statutory pay to workers on shared parental leave (SPL). A question many clients have asked since SPL was introduced in April 2015 and until now it has not been clear.
This should be seen for most as a positive outcome had the ruling gone the opposite way it may have encouraged companies to only offer statutory maternity pay moving forward.
Appeals heard in Chief Constable of Leicestershire Police v Hextall and Capita Customer Management Ltd v Ali.
